What is bankruptcy?

Bankruptcy is a legal proceeding in which a person who cannot pay his or her bills can get a fresh financial start.  The right to file for bankruptcy is a federal right.  Filing bankruptcy immediately stops all of your creditors from seeking to collect debts from you, at least until your debts are sorted out according to the law.

What can bankruptcy do for me?

Bankruptcy may make it possible for you to wipe out most or all of your debts, with some exceptions.  Bankruptcy may make it possible to stop foreclosure on your home and give you the chance to catch up on missed payments.  Bankruptcy may also make it possible to stop wage garnishment and debt collection harassment.

Bankruptcy will not normally wipe out child support or alimony obligations, student loans, taxes, and any fines or penalties owed to government agencies.  Bankruptcy will also not wipe out any debts that you don't list on your bankruptcy petition.

The filing fee for a Chapter 7 bankruptcy is $299.  The filing fee for a Chapter 13 bankruptcy is $274.  These fees are in addition to a flat fee paid to your attorney to prepare and file your bankruptcy petition.
